SODOMY CASE:The Suggested Solutions

Upon browsing through one of the local newspaper, i was attracted to read on two suggested solutions that might work apart from relying on our judiciary system. It is not that our judicial isn’t working well but since this issue is a little bit ‘extraordinary’;probable political motives and related to too many uncertain claims, it is better to find as many ways to help judges to fairly rule out the conviction. It is also to convince the public that the trial and investigations are made with 100% transparency and with justice.

1.Appoint religious group as mediator.

In Islamic point of view, the allegation of sodomy is far more complex; it is the matter of faith, Islamic laws and Islamic teachings. A religious organization which act as mediator to solve this case according to the right way of the Shariah will analyze the situation based on the above factor and later assist the court in terms of Islamic legality. For Muslims, when a ruling is made based on the Islamic law, it is deem as the truth and the most acceptable ruling.

On the suggestion by the incumbent Mufti Perlis, supported by Tok Guru Nik Aziz, called Mubahalah, I believe it is a necessary move but must be done behind close doors as it concerns individual dignity which is a very important aspect in Islam.

2.Establish an independent commission.

By this, the conspiracy theory of the government or of Anwar himself can be eliminated. An independent commission such as the Royal Commission endorsed by the Yang Di-Pertuan Agong, will ensure that the investigation is done in the most unprejudiced way. The police good name also will be safe from the accusation of corruption in this issue. Thus, the credibility of Anwar, police force and the government will nor be tarnished by the conspiracy allegations.
